EEOC Awards $78,000 in Age Discrimination Suit

The Equal Employment Opportunity Commission recently announced that a septuagenarian receptionist would be awarded $78,000 in a settlement over alleged age discrimination and disability discrimination. The woman was allegedly fired from her job after a brief hospitalization, despite no previous complaints about her job performance before or afterwards. This suit is a sign of how employers can harm older employees with their employment decisions, even against employees who are effective in their roles.

EEOC Rescinds Proposed Pre-Suit Conciliation Rule

The Equal Employment Opportunity Commission (EEOC) has rescinded a proposed rule that would have made it much more difficult for the EEOC to engage in pre-suit conciliation. The changes to the conciliation process were proposed to make it easier for employers accused of employment law violations to fight the accusations. However, the rule was ultimately rescinded due to the chance that it would have made bringing charges against employers too burdensome. Mandatory Tests for Antibodies Not Permissible According to EEOC

The Equal Employment Opportunity Commission (EEOC) has clarified a rule with respect to employers testing their employees for COVID infection. While it is permissible for an employer to test if an employee is currently showing signs of coronavirus infection, it is not permissible to test if they have COVID antibodies. This is an important distinction to make as people begin to return to work and the coronavirus continues to be a threat, even in places like New York where infections have leveled off. EEOC Issues Guidance on Returning to Work After Quarantine

With many states now beginning the process of winding down their quarantine, many businesses that have been shuttered are now looking at reopening and inviting their employees back to work. However, reopening after the pandemic carries with it many questions, including what obligation employers have with respect to protecting their employees. Fortunately, the Equal Employment Opportunity Commission (EEOC) has issued guidance, telling employers how best to reopen for business. Equal Employment Opportunity Commission Public Portal

On November 1, 2017, the Equal Employment Opportunity Commission (EEOC) launched a public portal that will give people online access to inquiries about discrimination. “The EEOC is responsible for enforcing federal laws that make it illegal to discriminate against a job applicant or an employee because of the person’s race, color, religion, sex, national origin, age, disability or genetic information.” The public portal will make EEOC information, as well as personal charge information, easily accessible. The features included in the public portal are currently available for all newly filed charges and any charges that were filed on or after January 1, 2016 that are currently in investigation or mediation. The famous Plaza Hotel, located in New York City, has had a sexual harassment lawsuit filed against it by some of its female employees.  The Plaza Hotel is an icon for its famous political figures and entertainers.  While many are shocked by the allegations, sexual harassment in the hotel industry is fairly common.  According to a recent report, 8 in 10 hotel workers have experienced being harassed on the job.
