An attorney who formerly worked for Panoramic Health has sued her ex-employer for alleged wrongful termination. The lawsuit, which was filed in federal court in Colorado, alleges that Panoramic fired the assistant general counsel after complaining about compliance issues related to anti-kickback statutes. She is seeking damages for being fired without appropriate cause, and for retaliation by the company.
What is Panoramic Health?
Panoramic Health is an Arizona-based healthcare company that specializes in providing care to people suffering from kidney related medical issues. This includes everything from dialysis for people suffering from kidney disease, as well as surgery and post-operative support. Its services cover more than 750 medical providers across the United States, and reportedly makes more than $25 million per year in revenue.
Why Are They Being Sued?
They are being sued by their assistant general counsel who was allegedly fired for raising issues about the company failing to comply with anti-kickback statutes with respect to its kidney care contracting program. Rather than attempting to correct these issues to remain in compliance with the law, it allegedly fired her. The company, meanwhile, denies any wrongdoing, and says that her dismissal had nothing to do with any legal issues she may have raised.
Why is This Illegal?
Both state and federal law prohibits employees from being fired for certain reasons, which is broadly known as wrongful termination. This typically means that the employee had a formal employment contract that required an employer to fire them only for certain specified reasons, such as some form of serious misconduct. However, it can also mean that someone was fired as a result of being discriminated against, or due to retaliation for reporting alleged misconduct by their employer.
